General Reveals Shaky Grip on 4th Amendment

General Michael Hayden, the Office of National Intelligence's deputy director of National Intelligence, the redundancy is a sign of things to come, was asked a very important question:

QUESTION: Jonathan Landay with Knight Ridder. I'd like to stay on the same issue, and that had to do with the standard by which you use to target your wiretaps. I'm no lawyer, but my understanding is that the Fourth Amendment of the Constitution specifies that you must have probable cause to be able to do a search that does not violate an American's right against unlawful searches and seizures. Do you use --

GEN. HAYDEN: No, actually -- the Fourth Amendment actually protects all of us against unreasonable search and seizure.

QUESTION: But the --

GEN. HAYDEN: That's what it says.

QUESTION: But the measure is probable cause, I believe.

GEN. HAYDEN: The amendment says unreasonable search and seizure.

QUESTION: But does it not say probable --

GEN. HAYDEN: No. The amendment says --

QUESTION: The court standard, the legal standard --

GEN. HAYDEN: -- unreasonable search and seizure (Philadelphia Inquirer).

If this does not chill you to the bone, then perhaps I should remind you, and Gen Hayden what the Fourth Amendment to the US Constitution actually says:

Amendment IV

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Could someone please send them a copy of the Constitution? Or better yet, could someone enforce it? The Constitution can only be changed by amendment. Neither the courts, the congress, nor a president who thinks he's an emperor can change it by will. There is a process and it must be followed.

Parshall Bigotry

Janet Parshall of the Fascist Religious program, Janet Parshall's America, I guess because the nation she describes on her show is one that only exists in her mind, was invited onto the most banal and inane hour of TV: Larry King Live (but not thinking). After coming frightfully close to justifying the murder of Matthew Shepherd

Was he, in fact, coming -- and this is no way, shape, or form, a justification of what happened because it was wrong, wrong, and wrong. Let there be no ambiguity there.

But, in reality, I understand that Matthew was somewhat of a person who hung around some of the gay bars and was coming on to some people. So, was he looking for trouble in all the wrong places (Media Matters)?

How could we get you wrong? You apparently think looking for a date could naturally lead to being savagely beaten and left to die. Why didn't he realize that two homophobic people would pick him up, rob, beat, murderer him? After all, he must have known that people like you, Pat Robertson, the Catholic and Baptist Churches... the Klan and numerous Republican politicians justify murder based on homophobia from being classified as the act of terrorism (hate crime) it it!

The she said this:

I think when two people of the same sex get together and they decide to use the moniker of a marriage, I think it's a grotesque misrepresentation, and actually, if that union decides that they want to then adopt children 'cause biology says they can't create children, then I think what you have in many respects is state-sanctioned child abuse because you've purposely taken away either a momma or a daddy, and mom and dad are both necessary in a child's life (Media Matters [emphasis added]).

Is the bitch crazy? I thought she had a screw loose when she put her fingers in her ears and refused to listen to Randi Rhodes on C-span, but the more I hear from this crazy lady the more I realize she is just a lunatic.

So, Janet, it child abuse to give a child two parents and not child abuse to deny them any parents? NAIC (National Adoption Information Clearinghouse) disagrees (Read their Fact Sheet Here). 'Nuff said.

3,200 Katrina Victims Still Missing

More than 3,200 people remain listed as missing some five months after Hurricane Katrina struck the US' Gulf coast, officials have said (BBC News).

What? We just can't find them?

More than 1,300 people across five states were killed by the storm (BBC News).

Sobering... Frightening... I really am speechless at the enormity of the whole thing... I really wonder how many really people died... How many of the missing are dead? Why isn't this on the TV every night? Why isn't the government doing more? Kanye West must have been right. Damn.

VA maybe for Lovers, but not Marriage

Virginia seems likely to join the list of states where voters will consider a constitutional ban on same-sex marriage and civil unions this year (Gay.com).

Like a plague of locusts, hate has spread its ugly wings and has begun to circle our nation yet again. This new millennium is off with a bang... Every two years or so our nation has been looking for new and inventive ways to strip rights from her citizens and to add inequality and hate to our state constitutions. Marital Segregation (civil unions/domestic partnerships) are being celebrated because separate but unequal is suppose to be better than nothing. Celebrating someone telling you are less than they are is the same as them pretending you don't exist.

Republican corruption is going to hit the polls hard... What can we do to distract people and continue harming the morals of the nation?

Virginia will be one of five states with an amendment referendum in 2006, along with South Carolina, South Dakota, Tennessee and Alabama. Alabama's showdown is in June; the other three are set for November (Gay.com).

Really? That should do it. Hate is stronger than love, and Fear is stronger than any other collective emotion a group can feel... and it is contagious. Fascists have always know this, and it is still true. If there is no one to fear or hate, create them. GLBT people are the only people it is politically correct to hate anymore, because if you challenge their hate, they claim you are discriminating against them.

They claim people choose to be GLBT, and thus they are not entitled to equal rights... Well, let us take their argument seriously: People choose to be religionists... People choose to be conservative... so by their logic, they are not entitled to equal treatment under the law. So fire every lazy right winger and evangelical Christian. If they sue, tell them they chose a harmful lifestyle that you cannot condone or support for the good of society. After all, no country that has accepted fundamentalist religion has ever survived: Rome, the Crusader States, Iran under the Shah, and Afghanistan, just to name a few.

This is the flaw in their logic. Whether or not it is a choice to be GLBT is moot. The way you treat the GLBT community is.

Gore: Domestic Spying threatens Structure of Government

WASHINGTON _Former Vice President Al Gore asserted Monday that President Bush “repeatedly and persistently” broke the law by eavesdropping on Americans without a court warrant and called for a federal investigation of the practice (Yahoo! News).

It is good to see a Prominent Democrat speaking honestly and not equivocating about dangerous overreach of power by a presidency that believes it has imperial power.

I do have to say, I wish this Al Gore would have ran in 2000 with someone other than that traitor to the Constitution (Joe “Never Question the Emperor” Liebermann). Perhaps this is a good sign of things to do.

Yet Another Boycott Against Liberty

The American Taliban threatens a boycott:

OLYMPIA, Wash. -- A pastor on Monday called for a national boycott of Microsoft, Hewlett-Packard and other companies that support a gay civil rights bill, saying the corporations have underestimated the power of religious consumers (Gay.com).

Now, there are a lot of reasons to support a boycott of Microsoft, but their support of Equal Rights has kept me from doing it. Here we are in 2006 and hate groups are still launching boycott of companies because they are in favor of Equal Rights!!!

I wish people would grow up and realize that Equality is not dangerous!

Boondocks on MLK

Did you see the Boondocks last night? The episode was titled, “Return of the King,” and dared to ask the question, “What would happen if Martin Luther King jr came back... The horror in Dr King's soul at the state of modern society should awaken us all to how far away from his dream we are. The most touching part of the episode was Dr King's book, “Dream Deterred.” The sight of such a great leader being mocked by a Bill O'Reilly style Fox News type talk show for being un-American and a national disgrace is probably the most chilling reflection on our modern world. We don't have a forum for proper debate, anymore. We don't stand up for what his right, anymore. We do not embrace the concepts of nonviolence, anymore.

Why, today of all days, do we tolerate racism in our government? From the disgrace continuing to unfold in New Orleans to national shame of racial profiling, we support injustice by not ending it.

Why, today of all days, do we tolerate sexism in our media? From the portrayal of women as nothing more than sex objects to the depiction of men as brainless sex starved buffoons, we support injustice by not ending it.

Why, today of all days, do we tolerate homophobia in our culture? From the absence of realistic portrayals of GLBT people in the media to the creation of a new separate but equal institutions, we support injustice by not ending it.

Why, today of all days, do we tolerate wars of choice in our world?

We have to stand up and seek truth, justice, and equality, and stop pretending the dream has been realized, we have a long way to go, and a hard road to follow. We need to begin by embracing the three principles of nonviolence.

Satyagraha is the philosophy of nonviolent resistance most famously employed by Mohandas Gandhi in forcing an end to the British Raj and also against apartheid in South Africa.

Satya is Sanskrit for Truth, and Agraha is used to describe an effort, endeavor. The term itself may be construed to mean any effort to discover, discern, obtain or apply Truth.

  1. Satya - truth; implying openness, honesty, and fairness.
  2. Ahimsa - refusal to inflict injury upon others.
  3. Tapasya - willingness for self-sacrifice (Wikipedia).

This would be a could start, and that is what we need, a good start, and great movement, and a triumphant victory.
